ACCEPTANCE OF TERMS: controlweedsnotfarming.com, including all website-related content and services (the “Site”), is provided by Modern Ag Alliance, a Missouri nonprofit corporation (“Modern Ad Alliance,” “Us,” “We,” “Our”) subject to your agreement to comply with the Terms of Use (“Terms”).  Your access to and use of this Site is conditional upon your acceptance of and compliance with these Terms. These Terms apply to everyone, including but not limited to visitors, users and others, who with to access and use this Site.

Please note that we reserve the right to update or modify the Terms without advance notice by updating this page and the “Last Updated” date above. If you do not agree to the Terms at any time, please discontinue your use of the Site.

PROHIBITED USES

You agree that you will use this Site only for lawful purposes and in accordance with all applicable laws, rules, regulations, and these Terms at all times. The following is a non-exhaustive list of prohibited uses of this Site. You agree that you will not perform, facilitate, or engage in any of the following or related prohibited uses:

  1. Impersonating or attempting to impersonate Modern Ag Alliance or its employees, representatives, or affiliates;
  2. Misrepresenting your identity or affiliation with any person or entity;
  3. Using or attempting to use the Site to engage in unauthorized advertising or promotional activities, including but not limited to spam, junk mail, chain mail or similar materials;
  4. Engaging in any conduct that restricts or inhibits any person’s use or enjoyment of the Site, or which, as determined by Our sole discretion, may harm Us or the users of this Site or expose Us or others to liability of any kind;
  5. Using or attempting to use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with another party’s use of the Site;
  6. Using or attempting to use any automated mechanism, such as a robot, spider, scrape, or similar automated technology, process or means to access or use the Website for any purpose, including monitoring or copying any of the material on this Site;
  7. Using or attempting to use any manual process or means to monitor or copy any material on this Site or for any other unauthorized purpose;
  8. Using or attempting to use any device, software, means or routine that interferes with the proper functioning of the Site, including but not limited to viruses, Trojan horses, worms, logic bombs or other such materials;
  9. Attempting to gain unauthorized access to, interfering with, damaging or disrupting any parts of the Site, the server(s) on which the Site is stored, or any server, computer, database or other such system connected to the Site;
  10. Attempting to attach or attacking the Site via a denial-of-service attack or a distributed denial of service attack;
  11. Otherwise attempting to interfere with the proper functioning of the Site;
  12. Make unauthorized use of any of Modern Ag Alliance’s trademarks, service marks, or other protected intellectual property;
  13. Using the Site in any way that violates any applicable federal, state, or local laws, rules, or regulations; or
  14. Any other activities that, in Modern Ag Alliance’s sole judgment, may be objectionable, abusive, or contrary to these Terms.

Notwithstanding any terms and conditions described, Modern Ag Alliance reserves the right to terminate your license and permission to use our Sites, and block or prevent your access to and use of our websites without notice and according to our discretion.

NO WARRANTY ON WEBSITE

YOUR USE OF THE SITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE IS AT YOUR OWN RISK. AVAILABILITY, ERRORS AND INACCURACIES

We assume no liability for the availability, errors or inaccuracies of the information, products or services provided on the Site. We may experience delays in updating information on the Site and in our promotional content on other websites. The information, products and services found on the Site may contain errors or inaccuracies or may not be complete or current. Products or services may be incorrectly described or unavailable. We expressly reserve the right to correct any errors on the Site. YOU AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS MODERN AG ALLIANCE, ITS SERVICE PROVIDERS, AND AFFILIATES FROM AND AGAINST ALL LOSS, CLAIMS, ACTUAL OR THREATENED LAWSUITS, DAMAGES, COSTS, LIABILITIES, AND ANY OTHER EXPENSE ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY ALLEGED VIOLATION BY YOU OR ANY THIRD PARTY OF THESE TERMS.

Certain states do not allow limitations on implied warranties or the exclusion or limitation of certain damages. Therefore, some or all of the above disclaimers may not apply to you.

Unless specified otherwise, the Site and all content and other materials on the Site including but not limited to all logos, designs, text, graphics, pictures, information, data, software, sound files and arrangement thereof (collectively, “Content”) are the proprietary property of Modern Ag Alliance and are either registered trademarks, trademarks or otherwise protected intellectual property of Modern Ag Alliance or third parties in the United States and/or other countries. You may copy reprint, publish, reproduce, or otherwise display materials created by Modern Ag Alliance and made available through Modern Ag Alliance (collectively, the “Modern Ag Alliance Works”) on the condition that you attribute those materials to Modern Ag Alliance and provide a link to the Modern Ag Alliance website (controlweedsnotfarming.com). Specifically, any article or materials that you reprint or otherwise reproduce must be displayed with its by-line, if applicable.

Except as expressly permitted above, you may not copy, reproduce, distribute, publish, enter into a database, display, perform, modify, create derivative works, transmit, or in any way exploit any material produced by Modern Ag Alliance. MOBILE MESSAGING TERMS AND CONDITIONS

These Mobile Messaging Terms & Conditions ("Texting Terms") govern your participation in the mobile messaging program (the "Program") offered by Modern Ag Alliance. By participating in the Program, you agree to abide by these Terms. If you do not wish to continue participating in the Program or no longer agree to these Terms, you can reply with "STOP" to any mobile message from us to opt out of the Program.

User Opt-In: The Program allows users to receive Short Messaging Service ("SMS")/Multimedia Messaging Service ("MMS") mobile messages by users affirmatively opting into the Program. Regardless of the opt-in method you used to join the Program, you agree that these Terms apply to your participation. Our mobile messages comply with all applicable laws, including but not limited to the Telephone Consumer Protection Act ("TCPA").

Program Description: Users who opt into the Program can expect to receive surveys from us concerning their opinion on important political and public policy matters.

Cost and Frequency: Message and data rates may apply. The Program includes recurring mobile messages, and additional mobile messages may be sent based on your interaction with us.

User Opt-Out and Additional Commands: To opt out (discontinue participation in the Program), reply with "STOP" to any message received or call us at [PHONE NUMBER NEEDED]. You may receive an additional mobile message confirming your decision to opt out. You may also opt out by texting “QUIT,” “END,” “CANCEL,” “UNSUBSCRIBE,” or “STOP ALL” to any message received.

MMS Disclosure: The Program will send SMS Mobile Terminated Messages ("MTs") if your mobile device does not support MMS messaging.

Our Warranty: We will not be liable for any delays or failures in the receipt of any mobile messages connected with this Program. Delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator and is outside of our control.

Privacy Policy: We respect your privacy. By opting into the Program or otherwise sharing your personal information with us in connection with the Program, you consent to the collection, use, disclosure, and sharing of your information as further outlined in our Privacy Policy.

USER CONTENT

This Site may include interactive areas or services, such as letter-writing campaigns or other areas or services that allow you to create, post, share, or store content or other materials on the Site (“User Content”). You are solely responsible for your use of the Site and use these areas or services at your own risk. By using the Site, you agree not to post, publish, or engage in any activities through the Site that would violate these Terms, including, without limitation to anything that is unlawful, a violation of the rights of any party, an infringement of any intellectual property rights of any party, abusive to any party, unsolicited promotions or advertising, intentional impersonations or misrepresentations, or any other objectional conduct that we determine, in our sole judgment, is objectionable or may expose us to liability.

You understand and agree that any information or content you submit to the Site are non-confidential and, unless otherwise specified, you grant us and our affiliates a nonexclusive, royalty-free, perpetual, irrevocable, assignable, transferable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such User Content throughout the world in any manner or media now known or later developed, including but not limited to fundraising and other communications by us without any right of compensation or attribution. You waive any moral rights you may have to the User Content you submit. You represent and warrant that you own and control all of the rights to the User Content that you submit, or you otherwise have the right to post such User Content to the Sites and that the User Content you supply does not violate these Terms and will not violate any rights of or cause injury to any person or entity.

Modern Ag Alliance takes no responsibility and assumes no liability for any User Content posted, stored, or uploaded by you or any third party. We explicitly disclaim any liability for any loss, damage, mistakes, defamation, omissions, falsehoods, obscenity, or abusive content you may encounter. Enforcement of User Content or conduct articulated in these Terms is at Modern Ag Alliance’s sole discretion and failure to enforce does not constitute a waiver of our right to enforce in the future. Modern Ag Alliance reserves the right to remove, at any time, any User Content we find in violation of these Terms or otherwise objectionable by our sole discretion.
